The Commissioner & Director of School Education, Hyderabad has submitted in the reference 7th read above that there is a need to rationalize services of surplus teachers in non-viable private aided schools and also viable private aided schools due to the fact that with reference to the prevailing norms certain private aided schools are having excess strength of students with less staff and certain other schools are having meager strength of pupils with more teachers.
Government, in this regard, have taken into account the following conclusive observations of the Division Bench of Hon’ble High Court of Andhra Pradesh in Writ Appeal No. 1578 of 2005 & batch and W.P.No.21793 of 2005 & batch, dt:29.12.2006, made while dealing with the provisions relating to rationalization in G.O.Ms.No.103, Education (Ser.V) Department dated: 05.08.2005.

School Education – The Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Managements) Rules, 1993 – Amendment to sub-rule (17) of Rule 10 – Orders – Issued.

ORDER:
The following notification shall be published in the extra-ordinary issue of the Andhra Pradesh Gazette dated 17.06.2013.
NOTIFICATION
In exercise of the powers conferred by Section 99 read with sections 20,21,79,80 and  83 of the Andhra Pradesh Education Act, 1982 (Andhra Pradesh Act 1 of 1982), the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Managements) Rules, 1993 issued in G.O.Ms.No.1, Education(PS.2) Department, dated 01.01.1994 as subsequently amended.
AMENDMENT
In the said rules, in rule 10, for sub-rule (17), the following sub-rules shall be substituted namely:-br /> (17)That when a private aided school is forced to be closed down for any reason or whenever the management of the school goes out of the way to remove any of its staff members or whenever there is fall in strength in a private aided school for two successive academic years or whenever an exercise for rationalization of aided staff working in aided institutions is taken up, the competent authority may transfer the staff, with or without posts, as the case may be, to any other needy private aided school within the District.
(17 A)Where, in pursuance of action taken under sub rule (17), an aided post in an institution is rendered surplus, the same shall stand suppressed on transfer of the incumbent to another aided institution with effect from the date of such transfer”.
